Terms of Service

1. Acceptance of Terms

By downloading, installing, or using DocFindMe ("Application," "Platform," or "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and DocFindMe, Inc. ("Company," "we," "us," or "our"), a healthcare technology company operating in the United States.

2. Description of Services

DocFindMe is a HIPAA-compliant digital health platform that enables:

• • Secure communication between patients and licensed healthcare providers
• • Medication tracking and schedule management
• • Emergency alert and backup contact coordination
• • Location-based hospital and care center discovery
• • Secure health record and care team management

3. Eligibility and Account Registration

You must be at least 18 years of age to use this Service. By using DocFindMe, you represent and warrant that:

• • You are 18 years of age or older
• • You have full legal capacity to enter into binding contracts
• • All registration information you provide is accurate and complete
• • You will maintain the accuracy of your registration information
• • You are not prohibited from using the Service under applicable laws

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Healthcare Disclaimer

DocFindMe is a communication and coordination platform — NOT a medical device — and does NOT provide medical advice. Information and communications on this platform do not constitute medical advice and are not a substitute for professional medical judgment.

5. Protected Health Information (PHI) and HIPAA Compliance

DocFindMe operates as a Business Associate under HIPAA (45 CFR Parts 160 and 164). We implement administrative, physical, and technical safeguards to protect your PHI including:

• • End-to-end encryption for all PHI in transit (TLS 1.2+) and at rest (AES-256)
• • Role-based access controls limiting PHI access to your authorized care team
• • Audit logging of all PHI access in compliance with the HIPAA Security Rule
• • Business Associate Agreements (BAAs) with all sub-processors who handle PHI
• • Annual HIPAA workforce training and security risk assessments

You have rights under HIPAA including the right to access, correct, and request deletion of your PHI. See our Privacy Policy for details.

6. User Obligations

You agree NOT to:

• ✗ Use the Service for any unlawful purpose or in violation of any regulations
• ✗ Share your account credentials with any third party
• ✗ Upload false, misleading, or fraudulent health information
• ✗ Attempt to access PHI of other users without authorization
• ✗ Interfere with the security or integrity of the platform
• ✗ Attempt to reverse-engineer or decompile any portion of the Service

Healthcare providers using DocFindMe further agree to:

• • Use the platform only for legitimate patient care coordination
• • Maintain applicable professional licenses and comply with scope of practice
• • Maintain patient confidentiality in accordance with HIPAA and applicable state laws

7. Intellectual Property

All content, features, and functionality of DocFindMe — including software, text, graphics, logos, and data — are owned by DocFindMe, Inc. and are protected by US and international copyright, trademark, and patent laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

8. Privacy

Your use of DocFindMe is subject to our Privacy Policy, which is incorporated into these Terms by reference. Our Privacy Policy explains how we collect, use, disclose, and safeguard your personal information and PHI.

9. SMS / Text Message Communications

DocFindMe uses SMS text messages solely to deliver one-time passcodes (OTPs) for account login verification when you choose phone-based authentication.

• •Opt-in: By entering your phone number on the login screen and tapping "Send Verification Code," you consent to receive one SMS per login attempt. Consent is not required to use DocFindMe — email and Google OAuth login are available alternatives.
• •Message frequency: Varies — one message per login or code-resend request.
• •Rates: Message and data rates may apply per your mobile carrier plan.
• •Opt-out: Reply STOP to any DocFindMe SMS to stop receiving SMS codes. You can continue to use the Service via Google or email login.
• •Help: Reply HELP or contact support@docfindme.com.
• •No marketing: We will never send promotional or marketing SMS messages. Your phone number is not shared with third parties for their marketing purposes.

11. Third-Party Services

DocFindMe may integrate with third-party services (e.g., Google OAuth, mapping services). Your use of such services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party providers.

12. Limitation of Liability

In no event shall our total liability exceed the greater of: (a) the amount you paid for the Service in the twelve months preceding the claim, or (b) one hundred US dollars ($100.00).

13. Indemnification

You agree to indemnify, defend, and hold harmless DocFindMe, Inc. and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit through the Service.

14. Termination

We reserve the right to suspend or terminate your access to DocFindMe at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, third parties, or our business interests. Upon termination, your right to use the Service will immediately cease.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the version number and effective date and, where appropriate, by providing additional notice (such as an in-app notification). Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of laws provisions. Disputes shall be resolved through binding arbitration under the American Arbitration Association's rules, except either party may seek equitable relief in any court of competent jurisdiction for intellectual property claims.

Class Action Waiver: You agree to resolve disputes on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.
